If Contractor notifies Subcontractor that any employee engaged in the Work is, in Contract opinion, persistently disorderly, uses threatening or abusive language to any other person, or is otherwise insubordinate, careless, incompetent, or unsuitable in a manner which is disruptive of the Work, Subcontractor shall promptly review the circumstances which prompted Contractor to notify Subcontractor of the problem and thereafter Subcontractor shall meet and mutually determine
whether (a) any action is necessary, (b) the employee is to be counseled by Subcontractor regarding the problem, or (c) such employee is to be permanently barred from engaging in the Work and otherwise from any continuing interaction with Contractor. An employee permanently barred from engaging in the Work shall not be employed again or engaged in any work in connection with the Facilities except with Contractor's specific prior written consent.
