11. Although the trust set up under clause 6 provides for the trustee for the time being to distributed the income and/or the capital of the trust to one or more of the beneficiaries at the trustee's discretion l record that my purpose in establishing the trust is to provide a fund for the financial security of the beneficiaries concerned and I accordingly express the wish that the capital of the trust be preserved as much as is practicable and income only be drawn upon.
Meaning of words
12. I inless the context otherwise requires in my will I declare that
(a) "appointment fails" means that before my estate or the trusts established under this my will have been completely administered the appointed executor and/or trustee predeceases me, dies after appointment, renounces or otherwise does not or cannot act or continue to act; and where the trustee is the sole trustee of a trust of which he or she is also a beneficiary "appointment fails" also includes the trustee becoming bankrupt . Similarly, where a person is to assume the trusteeship of a trust of which he or she is also a beneficiary, the appointment shall not take effect and shall be deemed to have failed if, immediately before the intended appointment is to occur that person is an undischarged bankrupt;
(b) "bank accounts" includes any bank accounts (including any term deposits) or any funds held at the date of my death whether on deposit, for a fixed term or otherwise in any financial institution, credit union, cash management trust or like institution;
(c) "cannot act" includes the inability to act because of a lack of capacity which for the purposes of my will shall be sufficiently established by the opinion or a certificate of each of two qualified medical practitioners as to such lack of capacity;
(d) "household contents" means all furniture, curtains, drapes,carpets,linen, china, glassware , ornaments, crockery, cutlery,pictures, collections, sound equipment , computer equipment , domestic appliances and utensils,garden
