“ERROR” shall mean any reproducible

“ERROR” shall mean any reproducible error, problem, or defect in the Software, resulting in an incorrect functioning of the Software, which renders the Software inoperable and/or which cause the Software to deviate materially from the specifications for such Software as set forth in the applicable documentation.


“NEW VERSION” shall mean a new version of the Software that includes or adds new functionality or adds substantially new features to the Software, including any major enhancements (designated by a progressing of the release number left of the decimal point following the version initially licensed).


“SOFTWARE” shall mean Supplier’s software in object code only, including without limitation, and as applicable, the Updates (as defined below) and any modifications in and to the Software provided to LICENSEE under this Agreement, and any copy or portion of the Software.

“UPDATE” shall mean a new version of the Software, that contains error fixes as well as maintenance work product that correct programming and/or design errors, (designated by a progressing of the release number right of the decimal point following the version initially licensed), which is made available at no additional cost by Supplier to its customers generally.
