Other terms:
1. Buyer shall notify the nominal P&I covered vessel with full particular and to declare 10 working days pre-advise of vessel arrival notice.
2. After vessel’s charter by buyer, they must send particular report to seller in order to acceptance to signature return to buyer.
3. If the vessel is not arrived at load port according to the mentioned laycan, Buyer shall be obligated for lighter demurrage and must fully reimburse the lighter demurrage to seller at actual rate per ton per day which to be counted from day of 11 until completed loading
4. In clause 3, regarding loading rate which shows that “Detention charge shall be arising if the vessel cannot commence loading after 12 hrs of N.O.R. tendered at actual rate per day pro rata. Master’s Notice of Readiness (NOR) to be accompanied by a certificate issued by a sworn Surveyor appointed and paid for by Seller showing that vessel is ready in all aspects to load the cargo in all compartments or where the cargo to be loaded.
5. Force Majeure: Should the sellers fail to deliver the contracted goods or effect the shipment in time by reason of war, flood, fire, storm, or any other causes beyond their control, the time of shipment might be duly extended or alternatively a part or whole of the contract might be cancelled by the sellers to submit a certificate attesting such an event or events to buyer.
6. Arbitration: “Both parties agree to accept the Thai Commercial Arbitration Rules to govern the resolution of their dispute. In the event of any disagreement or dispute concerning or arising from this contract where the parties are unable to reach agreement such disagreement or dispute shall be finally and exclusively settled by arbitration under the Thai Commercial Arbitration Rules
