Defendants were convicted in the United States District Court for the Western District of Washington, Walter T. McGovern, Chief Judge, and Morell E. Sharp, and Donald S. Voorhees, JJ., of violating gambling provision of Organized Crime Control Act of 1970. On appeal, the Court of Appeals, Choy, Circuit Judge, held that provision of Organized Crime Control Act of 1970 proscribing gambling applied to defendants' conduct in operating large-scale gambling businesses on Indian trust land, including conduct of several defendants who were Indians and were immune from prosecution under state law.
