If a system of damages were to rely solely on compensation there are situations where it would be rendered ineffective. If damages from illegal conduct are confined to the victim'losses, the inherent deterrent effect of compensatory damages may be sufficient. However, when illegal conduct gives rise to profits that are greater than the illegal conduct will not be caught, a puerly compensatory system of damages will fail to provide adequate deterrence. Although there may be occasion to recover these additional profits under an unjust enrichment theory, there is enough uncertainty in such a system that deterrence is inadequate.
