Dear Sir/Dear Madam,
I want to inform you that Bare Lifts is a registered Trademark that is owned by Telebrands Corp. However, those Bare Lifts that are sold by your company are copycats of the original Bare Lifts.
Additionally we have found that your company is using the trademark Bare Lifts on a commercial basis to sell the Bare Lifts copycats. Hence, you are violating the acquired trademark rights of Telebrands Corp. Also, by using the identical name “Bare Lifts” your company is creating confusion for the customers and is also influencing the reputation of Bare Lifts in a negative manner. Therefore is your company unjustifiably benefiting from the reputation of the trademark Bare Lifts.
Bare Lifts is a private label brand of our partner company in the USA. Sale of this brand is only happening sporadically by one selected party. However, we have established that your company is selling Bare Lifts copycats. You can verify this by looking at the packaging of those “Bare Lifts”. You will see that the packaging does not show a printed barcode and no contact details of Telebrands Corp. (USA). Also we have tested Bare Lifts copycats. Those test results showed that the copycats failed the Chlorinated Paraffines, Lead and Cadmium total content, PAH (Polycyclic aromatic hydrocarbons) and Phthalates according to REACH. Additionally Ethylhexanol, Phenol and Naphthalene were detected in high/increased concentrations. The first two substances may cause skin irritations at prolonged skin contact. Phenol is a toxic substance which can be adsorbed by skin, and there is further a risk of irritations at skin contact. Naphthalene, on the other hand, belongs to the Polycyclic Aromatic Carbons (PAH). These substances are carcinogens or suspected to cause cancer (test results on request). From the above it might be clear that those Bare Lifts could not be lawfully placed on the market and that your company is facilitating the sale of copycats.
Therefore we urge your company to stop the sale of the Bare Lifts copycats.
I look forward to your reply before Monday the 12th of October 2015.
