Referring to the handover procedures and documents required. In this case regarding clients Plot 9 and 13 at the signature villas, the following is to be presented/issued to the owners –
• Drawings - Full set of drawings – under normal contract sales/purchase agreements As Built drawings are to be issued to the client/owner. The reason being these drawings are the adjusted/revised drawings from the original construction drawings due to the following –
1) Any changes during construction period requested/confirmed by architect
2) Any changes during construction period requested/confirmed by developer
3) Any changes made during construction period requested /confirmed by client/owner.
Note – The reality at Signature is Pornpol are no longer involved, the contactor is always responsible for issuing the as built drawings following completion so I am assuming as builts are not available therefore presume the original construction drawings are available in this case to issue to owner. Also note any client/owner that might be associated/involved in this industry do have the right to reject original construction drawings and demand as built drawings under normal terms/conditions of sales/purchase contract agreements.
• Testing/commissioning document showing results confirming electrical, air-con, water hot/cold plus relevant pressure, swimming pool, drainage systems are in good working order.
• Materials specifications – i.e. all material’s used – floors/walls/ceiling’s/paint/sanitary ware etc. all has to documented along with make/model/serial numbers and suppliers contact details.
• All guarantees/warranty’s/manuals for all systems and appliances have to be provided, again with suppliers/make/model/serial numbers.
• All government issued documents confirming house registration/book plus land/plot confirmation along with relevant government department stamps for authenticity.
• Full set of keys plus master keys if included in agreement
• An agreed defect list between owner/developer to be compiled issued during handover/acceptance meeting. ( example I will be covering this with plot 9 owner next Wednesday)
• Completion/handover certificate to be compiled by developer issued to owner confirming first date of occupation which is confirmed as the start date of the 1 year liability period. This document includes signatures of agreement/acceptance of the property by the owner, countersigned by the developer. Also noted in this document is all documents issued (as above) plus confirming owners responsibilities following occupation thus releasing developers responsibilities accordingly.
I would like to advise that all of the above is be put together as one package and issued to the owners in one meeting. Reason being if done in “bits and pieces” the owner can decline to sign acceptance if any documents are missing at arranged handover meeting. Plus whilst the owner is occupying there is an issue of “owner wear and tear” that can arise where floors as an example could be scratched by the owner moving furniture then the owner might argue it’s a defect to be repaired during the liability period free of charge.
Given the above a time frame needs to be confirmed whilst all documentation etc. is accumulated.
