Firstly, the charges levied against me are very unreasonable:
1. My intensions were sincere in that I wanted to find out what was happening to our common property on the 28th floor. In fact, if management would have informed the co-owners of what they were planning to do my visit to the 26th and 28th floor would not have been necessary. Khun ...... , the owner of condo 2501 and 2701, is a member of the Management Committee. Please note that the Thai Condominium Act requires co-owner approval for any demolition of common property. This was not obtained.
2. No ‘NO ENTRY’ signs were observed and all doors were open on the 26th floor. Although staff was present not a single person informed me that this was private property nor did they ask me to leave or refrain from taking photographs.
3. I merely spent a few minutes on the 26th floor to see what was going on, to take some photographs and to determine whether it was safe to visit the 28th floor.
4. If the owner objected to my presence for these few minutes - despite his absence - he could have requested the manager of the Casa Viva Juristic Person to inform co-owners and tenants not to visit the 26th floor. This would have been a more reasonable course of action.
