Appeal was taken from an order of the United States District Court for the Southern District of New York, Robert L. Carter, J., directing verdict as to liability and making findings as to damages in copyright infringement action. The Court of Appeals held that: (1) alleged infringer's testimony was insufficient to establish invalidity or waiver of copyright, and therefore his sale of copyrighted old-time radio plays was infringement of copyrights; (2) question of damages should not have been taken from jury, and remand was appropriate for election of statutory damages or new trial limited to issue of actual damages; (3) punitive damages are not available in a statutory copyright infringement action; and (4) award of attorney fees was not an abuse of discretion, however, remand was appropriate inasmuch as determination would be affected by damages issue.
