1. Objectives
Thai Airways International Public Company Limited (“THAI”) are pleased to invite you (“Bidder”) for participation to a bid of purchasing Aircraft Part as described in Exhibit 2 to the Invitation Letter (the “Bid”).
An offer for the purchase (“Proposal”) shall be submitted according to the terms and conditions stated in the Invitation Letter and its attached Exhibits.
2. Condition of Aircraft Part On Delivery
Aircraft Parts are offered for sale by THAI on an “As Is, Where-Is” condition. There is no warranty or liability extended nor offered under this Bid Program.
3. Place of Delivery
Place of delivery by THAI is the location of the storage at THAI’s facilities, Thailand.
Packaging, arrangement of shipping and shipment are of the responsibility of the awarded Bidder. If packaging is required, there will be a separate charge subject to mutually agreed terms which must be notified of such the requirement to THAI at the time of Proposal submission.
Costs and expenses of and due to transportation, insurance as well as any other related costs will all be responsible by the awarded bidder.
THAI will take no responsibility nor liability upon the release of parts to the awarded bidder.
4. Delivery and Acceptance
Once the package is declared ready for dispatch, the awarded bidder is required for picking up the shipment no later than 15 (fifteen) business days after receiving a notification by THAI. Any further day beyond such will be subject to storage charge at the rate of USD 65.00 per square meter per month.
In case of no action on picking up after 30 (thirty) calendar days of receiving a notification of readiness to release, THAI reserves a right to cancel the sale with no obligation nor any paid amount by awarded bidder be refunded.
5. Qualification of Bidder :
5.1 A Bidder must meet the following qualifications:
5.1.1 Be a legal entity with evidence of Company Registration/Affidavit
5.1.2 Not ever been declared on blacklist by THAI
5.1.3 Have a proof of reliable fund
5.2 Bidder must act as principal for its own account and not as agent or broker. If any Bidder has a coordinator in Thailand, the name and contact details of such coordinator must be clearly specified in the Proposal. Failing of which may cause disqualification of the Bid.
THAI will sign a contract with the awarded Bidder only, not through any other entity.
