According to our survey and information obtained, we noted that at the time of picking up the cargo at Bangkok port warehouse, your customs broker found that pallet were damaged. Then, Survey Note was requested to substantiate the damage. After that the cargo was delivered to your factory. Upon receiving, your warehouse staff found that 1 pallet was broken and the other 5 pallets were crushed and dented. After completing of checking, 23 cartons of ACCUMULATOR (2.0Kgf/cm2) totally 345 pieces were used and accepted as sound but other 125 cartons were rejected as damaged. Then, they took photos as evidence. The matter was notified to the insurer, and our survey was later requested.
On our attendance, 125 cartons were set aside as damaged in various places. 2 pallets No.2 and 4 were slightly crushed and dented but KYE did not break the pallet and rejected these 2 pallets. We found some cartons were crushed and torn showing the cargo therein with trace of having been hit against some hard object. Most of the cartons were crushed and dented. Upon unpacking, we found that the inner cargo had no visible damage but there was trace of cargo being press on the bottom of the carton.
From the condition, KYE insisted that 125 cartons were not fit to use since the pallets were damaged and sustained the impact.
To advance this loss, we appreciate if you could send the Notice of Claims to Shipping Carriers, Freight Forwarder, Transportation company, etc (all related parties) for the said shipment immediately. Meantime, we advise that the following documents (marked with X) are necessary in order to proceed with this claim following completion of survey. We therefore would ask you to submit us with them at your earliest convenience:
(X) Condition of cargo or photos of cargo before vanning(ask from shipper)
(X) Survey Note from Bangkok port ( ask form shipping agent)
(X) Tally Sheet at the time of devanning ( ask form shipping agent)
(X) Delivery Note or Cargo Receipt at the time of receiving the cargo at your factory
(X) Copy of Notice of claim to the carrier
(X) QC Report with reason why these 125 cartons could not be accepted/used?
(X) Please let us have your confirmation all 125 rejected cartons would be sent to shipper for checking the condition or not? KYE could not check the quality and must be checked by shipper.
