(2) The Power to Commit the Act. It shall also be considered whether the person who commits the act constituting the offense has the cause to lawfully commit such act. If it turns out that the person has the power or the right to commit the act, he shall not be held criminally liable.For example, Dum intentionally shot Daeng; if Dum acted so in order to defend himself or another person from imminent danger and did so in the appropriate proportion against such danger under Section 68, Dum shall not be liable for the act. For another example, a civilian arrested an arson offender who was escaping the scene shall not be liable for the offense against liberty as he had the power to do so.
