For road or rail carriage that are domestic or cross-border within South and/or North America or
domestic within Asia Pacific the Service Provider is considered primarily responsible and liable
for damage and/or loss of Goods which has occurred during its period of responsibility as set
forth in Section 11. Additionally, the Service Provider is considered responsible and liable if
failing to report to the Buying Company any damage and/or loss that should have been detected
when taken possession of the Goods. However, the liability of the Service Provider under this
clause shall not exceed the least of:
(i) the replacement cost (including but not limited to the value of the Goods) at the intended
destination; or
(ii) the reasonable cost of repair in case of damage.
For road or rail carriage that are domestic or cross-border within South and/or North America or
domestic within Asia Pacific the Service Provider is considered primarily responsible and liable
for additional costs incurred by any Authorized Company as a result of unreasonable delay in
the delivery of the Goods.
