Notwithstanding the preceding two P

Notwithstanding the preceding two Paragraphs, the Confidential Information shall not include any information which:
(1) the receiving party already possesses at the time when such information is disclosed to, provided to, or learned by such receiving party;
(2) is already publicly known at the time when such information is disclosed to the receiving party, or becomes publicly known for reasons not attributable to the receiving party;
(3) the receiving party legitimately obtains from a duly authorized third party without assuming any confidential obligations;
(4) the receiving party develops duly and independent from this Agreement; and
(5) is disclosed or provided in accordance with the law or regulations, or a request of an administrative agency or court.
