9 days of paid annual leave are given per year only after working one full year’.
The following explanation in English may be a little difficult. But please use a dictionary and read it through. I am writing important things.
Regarding this clause 2.3 (1), my original draft was just ‘9 days of paid annual leave are given per year’. But the officer of Prawet Branch asked us to change the sentence as above. So, we changed it by following her instruction.
On the other hand, I promised each one of you here that all of you can have 9 days paid annual leave from the 1st year. So, in this case, my promise with each one of you prevails over 2.3 (1). Please therefore do now worry.
A company and each employee can agree differently from Regulation on Work as long as such different agreement does not violate Law of Thailand. This case of 2.3 (1) is this.
My promise is, however, based on mutual reliance and conscience. So, in future, if there is someone who abuses this promise and uses up all 9 days and leave our company in short period, it will make me difficult to make the same promise with our future staffs.
