3.4.2 The Concessionaire shall be responsible for the design, procurement, testing and commissioning of Level 4 Maintenance activities. The Concessionaire shall also be responsible for Level 5 Maintenance (other than minor matters which the Concessionaire carries out as part of its day to day Levels 1 to 4 Maintenance activities) and for the preparation of technical and commercial proposals for this work provided in each case to the extent it is instructed to do so as MRTA Variation order.
3.5 Asset Management during the Defect Liability Period
3.5.1 The following key activities will be detailed in the Maintenance Services Plan and the Concessionaire shall:
(a) monitor, observe and make recommendations to MRTA in order to assist MRTA (either itself or through the MRTA’s representative) in ensuring that defect correction activities are performed in a timely manner and to the required standards and to assist MRTA (either itself or through the MRTA’s representative) in managing such activities;
(b) carry out prompt defect correction activities to ensure that the work is carried out in a manner which will not compromise the safety of the Railway System and that all affected systems, plant, machinery and equipment is tested and certified safe for revenue service before being put into revenue service and shall assist MRTA (either itself or through the MRTA’s representative) in managing such activities (it being acknowledged that the primary role of supervising and managing such activities rests with MRTA (either itself or through the MRTA’s representative));
(c) monitor via the CMMS the status of spares usage and the efficiency of the arrangements intended to ensure the availability of spare parts and for the prompt repair or replacement of defective components;
(d) review any amended as-built records issued to assess whether they reflect modifications or changes to the Concession Assets and to promptly report any inconsistencies to MRTA;
(e) monitor and report to MRTA any instances where a variance between the as-built records and the actual installed system are found;
(f) Use all reasonable endeavours to ensure compliance with the relevant obligations under the Purple Line safety case when working on systems, plant, machinery or equipment of Purple Line, Khlong Bang Phai Station to Tao Poon Station Section;
(g) monitor the system performance and failure statistics of the Concession Assets to confirm the rectification of defects and identify any new defects that may occur during the Agreement Period;
(h) Support the MRTA’s representative in maintaining records of all known outstanding defects to be corrected and in actively progressing the matter to completion where the Concessionaire is aware or sought reasonably to be aware of the defect and to provide reports to MRTA on the current status; and
(i) carry out failure trend analysis and establish areas where improvement is required to meet their contractual obligations to MRTA in terms of reliability, availability, maintainability, safety and appearance.
