In this case, BSTMT could send PCS a notice under Clause 6.3 claiming that PCS had breached the Contract by providing unqualified security guards and, if PCS does not improve, BSTMT could terminate the Contract . However, the drug test have not been conducted by authority or with the presence of authority, it could be argued later that the drug test was not legitimate. In case, PCS or Security guards deny all accusations, it will be difficult for BSTMT to prove that PCS had breached the Clause 6.3. All in all, we do not recommend this option.
