In this Part, I examine different potential regulatory levers to address ethical concerns with medical tourism, and their challenges. I focus on the tools available to the medical tourist patient’s home country in Part II.A. I begin by discussing regulatory levers uniquely available in government-prompted and insurer-prompted medical tourism, before turning to ways to control medical tourism for those paying out-of-pocket, a much more challenging problem. Parts II.B and II.C discuss the possibility of destination country and international (bilateral, multilateral) forms of intervention much more briefly. Part II.D briefly discusses “regulation” by industry, which can be thought of as an adjunct or alternative to these other forms of regulation.
