We have discussed internally and are pleased to respond as follows.
We understand that:
1. Suntowers agrees to refund the deposits in full. These total 1,854,275 THB and are detailed below:
a. TEPT and TGPT damage deposit: 1,104,075 THB
b. TEPT misc deposits: 750,200 THB
2. Suntowers do not currently have a prospective new tenant and do not wish to retain any fixtures and furnishings.
3. Suntowers’ preference is to reinstate TEPT’s and TGPT’s office space. We also understand that it is Suntower’s preference to undertake the work themselves. It is probable that the refurbishment will be undertaken for the entire floor 22 when the other tenant (UBA) leaves in 2015.
4. Suntowers has requested TEPT/TGPT to make a financial proposal.
5. Based on the above, TEPT/TGPT would like to propose that Suntowers retains all deposits, i.e. a total 1,854,275 THB as a full and final settlement of all TEPT’s and TGPT’s obligations under the respective Lease Agreements, as amended by Addendum, both dated 19th October 2011 and the respective Facility Service Agreement of the same date.
We would be grateful if you could propose this to the Suntowers Board as soon as possible so that we may conclude this matter in the coming days.
