clause 4.Bill payment agent
the Customer is required to make the services payment by cash; however, tesco lotus shall not receive payment exceeding bath 49,000 (forty nine thousand) per transaction. Upon receiving the payment, tesco lotus shall issue a receipt of payment or any document evidencing that the customer already makes the payment for the purchased services; and it shall be deemed that the receipt of payment and such document as aforementioned is issued by thai lion air
Notwithstanding the foregoing, the parties agree that all services payment shall be completed and deemed that thai lion air already receives such payment from the customer when tesco lotus issues evidence or receipt of such payment to the customers. date and time specified in the said document shall be the date and time of receiving the services payment of which is paid by customers.
Tesco lotus agrees to gather and collect information in relation to transaction of services payment to have been paid by customer within the nest day following to the day that the payment is made, and tesco louts shall transmit such information (transfer file) to thai lion air for acknowledgement of such payment transactions and for the purpose of using the said information with respect of providing the purchased services to customers within 13.00 hrs. of the day.
In the case that thai lion air (i) does not download or use such information as mentioned in preceding paragraph of this clause or (ii) refuses the payment to have made by customers or (iii) commits any action which causes any loss and damage to the customers and/or tesco lotus, thai lion air shall remedy or correct such loss and damage arising to the customers, including make an clarification statement to public or customers with a content that it is not tesco lotus's mistake or default. in this regards, Thai lion air shall be responsible to compensate the customer and/or tesco lotus for damage (if any) arising to them.
