We refer to your claim letter date September 5, 2014 for the amount of above with reference to your supporting documents we noted that said claim amount being calculated based on the sum insured. We are unable to verify that the sales of the affected fruits was conducted over a period of one month after it was devaned with the last sale just concluded on 3 Sep. and also we do not verified that the condition of the cold store at your end where these fruits were kept
For your reference we would like to inform you that based on Thai Cogsa’s regulations there is a limitation package which states that we as a carrier are entitled to apply the Baht 30 per kilo. Although this is the law we agree that an unreasonably small sum of money would not be fair to you.
In order to finalize the case amicably on without prejudice basis and without admission of liability, we would offer you a fair and final settlement of THB 287,900 (AUD10,000) (Base on exchange rate of Bank of Thailand on September 15, 2014 one AUD is THB 28.79) .which is both a great deal more than the Thai Cogsa limitation package value and also reasonable in the eyes of the insurance company. Bearing this in mind I believe that we can negotiate a fair and reasonable settlement thereby maintaining everyone’s best interests.
