Hi Jamie-- I've reviewed the materials forwarded. I don't see anything contained therein which would preclude a Xyratex employee who executed a Custodian or Team Member Confidentiality Undertaking from terminating employment with Xyratex and undertaking employment with a different Seagate subsidiary. I do think, though, that any Xyratex employee who executed a Confidentiality Undertaking and who subsequently becomes employed by a different Seagate subsidiary should be required, if possible, to sign an agreement reaffirming his/her obligations to maintain WD information as confidential and to not disclose or use it in connection with his/her ST employment. Should a member of the Xyratex WD Support Team leave the Team and undertake other duties within Xyratex we should probably discuss what steps should be taken to ensure WD information that he/she may have obtained while working for the Team.
