(1) the Works under the Contract are complete except for minor omissions and minor defects:
(i) which do not prevent the same from being reasonably capable of being used for their
intended purpose provided that the same do not affect the proper functioning of the Works;
(ii) in relation to which the Project Manager determines that the Contractor has
reasonable grounds for not promptly rectifying them; and
(iii) the rectification of which will not prejudice the convenient use of the Works;
(2) those tests which are required by the Contract to be carried out and passed before the
Works reach Practical Completion have been carried out and passed;
(3) documents and other information required under the Contract, which in the opinion of the
Project Manager are essential for the use, operation and maintenance of the Works have
been supplied; and
(4) the Contractor shall have satisfied all legal requirements of all necessary authorities as to
the fitness of the Works for occupation;
