We are pleased to provide you our revised offer, based on our recent discussions. The
primary purpose of this revision is to update our budgetary proposal to a firm offer, and to
change the party to whom this offer is made, from that which was named in our previous
proposal, and to make several minor clarifications or corrections. All other particulars of
our previous offer “TH-THI-151300-01” dated 15 July, attached hereto, remain in effect,
except as noted below:
1. Remove the term “Budgetary” where it appears throughout the previous proposal.
2. Our Preliminary Design Criteria (referenced in Note 1), a Statement of Work, and
Preliminary General Arrangement Drawing is attached to this revised proposal.
3. Crane hire (Note 3), and Shipping Costs (Note 6) are not included in this offer, but it
agreed that these items may be quoted and included per mutual agreement at an
additional price on a cost reimbursement basis at a later time. In any event, our
prices do not include any taxes in the country of Thailand, import fees, customs
duties, or other levy’s or encumbrances on the project within the country of
Thailand. Prices for material as noted in our offer are FCA (Free Carrier) – Our facility
(Dubai and/or Jebal Ali) per Incoterms 2010, unless or until modified by mutual
agreement to include transportation in our scope of work.
4. Our tentative Project Schedule as discussed during recent visit is attached to this
offer, which replaces Note 7 in our original offer.
5. Our payment terms we are offering (Note 8) are modified as follows: Mobilization
Payment (at time of contract award) - 15%; Design Completion - 35%; Fabrication
Complete / Prior to Shipment from Factory – 40%; Hand-Over: 10%.
6. Note 9 is changed as follows: This is a firm offer for acceptance. Offer is valid for
30 days from the date indicated above. Our offer is based on our standard
proprietary design criteria which assumes UBC seismic zone 1, and unflagged wind
speeds of up to 209 km/hr, with no icing conditions. The Buyer must provide a
detailed soil investigation report, to be carried out by an independent 3rd party at
the exact location of the proposed flagpole along with details concerning local
seismic activity at the proposed location and any other local conditions or building
codes.
As stated above, all other particulars of our previous offer remain in effect. We are pleased
to submit this firm offer for your acceptance, and look forward to moving forward on this very
prestigious project.
