Article 5: Adopting Decisions
{l) Decisions and recommendations shall be adopted by consensus of the delegations
co the Incernational Commission. Should consensus not be attainable,
the President of the Commission shall declare, that all efforts at
reaching agreement by consensus have been exhausted. Unless otherwise
provided in the Convention, the Commission shall in this case adopt decisions
or recommendations by a four-fifths majority vote of the delegations
present and voting.
(2) The decision shall become binding on the first day of the eleventh month
following the date of its adoption for all Contracting Parties that voted
for it and have not within that period notified the Executive Secretary
in writing that they are unable to accept the decision. However, such notification
may be withdrawn at any time; the withdrawal shall become effective
upon racei?t by the Executive Se'cretary. Such a decision shall
become binding on any other Contracting Party which has notified the Executive
Secretary in writing that it is able to accept the decision from
the moment of the receipt of that notification or on the first day of the
eleventh month following the date of the adoption of the decision, whichever
is later.
