6.3 Local Employment Requirements
(a) In accordance with the Concession Requirements, the Contractor shall use its best efforts to hire Lao employees and utilize Lao products and services as set forth in Schedule 5 and to provide reasonable evidence showing such compliance; provided that such obligations of the Contractor shall be subject to the condition that the Lao product, services and employees shall meet the designated qualifications prescribed by the Contractor. If the Contractor is in breach of this obligation which causes the Employer’s violation of the corresponding requirements under the Concession Agreements, then the Contractor shall indemnify the Employer for any fine or payment to the Government imposed upon the Employer in respect of such violation.
(b) Without limiting the Contractor’s indemnification obligation in clause (a), if the Contractor has complied with all required recruitment procedures and the Contractor is still unable to find sufficient Lao workforce, the Contractor shall notify the Employer of the reason and evidence of such efforts exercised by the Contractor to the Employer for consideration before recruiting labor from other sources.
