2. Under the current Thai Patent practice, there are no legal provisions or published decisions providing amounts of reasonable compensation and thus, we cannot advise on the amount of reasonable compensation. However, the Thai Patent Act (B.E. 2522) does provide following specific conditions to be followed while considering the compensation amount:
a. The wage and the duty of the inventors
b. The importance of the invention
c. The benefits, the right owner/employer will receive from the inventions
d. The perseverance and expertise that the inventors/employee (including the co-inventors) are used to invent or design the product.
e. The right owner/employer’s assistance in the invention or design of the product.
