Article 26. Expert appointed by arbitral tribunal
Under HK law an arbitrator may appoint an expert, and has similar power in that regard. Of course the expert is also subject to cross-examination. There is no specific provision in the Ordinance to this effect, but the powers have been recognized in the authorities. The model law provision is, however, very much a reflection of the continental system, where experts have a much larger and more persuasive role. (cf. Rules of the Supreme Court, Order 40)
