8. ERRONEOUS, EXCESS OR SHORTAGE OF DELIVERY
1) Unless otherwise instructed by the Buyer, the Seller shall withdraw, at its own expense and no later than the date designated by the Buyer, any and all items delivered in error or excess of the Contract.
In the event of the Seller’s failure to accomplish a timely withdrawal of the erroneously delivered or excess items, the Buyer may arrange by itself to return such items to the Seller at the Seller’s expense.
2) In the event of any shortage of delivery of the Goods or parts thereof, the Seller shall:
a) At it’s expense, promptly supply the item(s), which was not delivered, on the basis of DDP Buyer’s designated place as per INCOTERMS 2010 in accordance with the Buyer’s shipping instructions. The Buyer may undertake the transportation of such item(s) at the Seller’s expense;
b) bear the cost of installing such item(s); and
c) at the Buyer’s request, promptly dispatch the Seller’s field engineer(s)/Supervisor(s) to the Site at the Seller’s expense for engineering service and technical assistance for installation and/or commissioning thereof.
