Please be advised that Thailand has not yet been a member of Madrid System. We are on the way of joining the system. The Thai Department of Intellectual Property (DIP) said that it is expected to be a member by the end of this year 2015.
Currently, there are 95 member states around the world. The person who can file the application under Madrid System must be a natural person or a legal entity which has a real and effective industrial or commercial establishment in, or is domiciled in, or is a national of, a country which is party to Madrid System.
Therefore, we are unable to filing the trademark application under Madrid System in the name of Thai Company. If you would like to file the trademark application in the name of Thai Company, we must file separately in each country that you would like to obtain protection.
For India which is a member of Madrid System, therefore, you can file the trademark application under Madrid System in the name of Indian applicant. You must firstly file a trademark application in India and then file International Application with the WIPO and select the member states which the mark to be protected. The fees will depend on the number of countries that you would like to protect.
To summarize:
1. If you would like to file trademark application in the name of Thai Company, we recommend you filing in each country that you would like to obtain protection as soon as possible. The trademark application is a first-to-file system. Please do not wait until Thailand is a member of Madrid System.
2. If you would like to file trademark application in the name of Indian Company, you may use the benefit of Madrid System. Please confirm in order for us to further discuss on the fees with our Indian agent.
