11 If identical replacement Spares cease to be available and no compatible updated versions are available, the Concessionaire shall identify alternatives of equivalent quality but shall not proceed with the procurement of such alternatives without the approval of the MRTA. The Concessionaire shall assist the MRTA in determining whether any differences between the original and the alternative spares will affect the safety, reliability or maintainability of the Railway System.
12 If the Concessionaire becomes aware that any spare part is likely to become unavailable and no equivalent is available of comparable quality or at comparable cost, the Concessionaire shall advise the MRTA of the current and anticipated rate of usage such that a stock of spares sufficient for the remaining anticipated service life of the equipment involved may be purchased before the spare part becomes unavailable. The cost of those spares purchased for periods in excess of the remaining term of the Agreement shall be paid as additional costs.
13 The Concessionaire shall maintain the inventory of Spares, Maintenance Equipment, tools and software up to date at all times and shall make this available to the MRTA on demand. At intervals not exceeding 12 months and 6 months prior to expiry of the Agreement, the Concessionaire shall arrange for a joint inspection with the MRTA of Spares, Maintenance Equipment, tools, software and the inventory.
14 The Concessionaire is responsible for arranging customs clearance for the import of all Spares, tools and other equipment required for the performance of the Services. The MRTA shall provide such reasonable assistance as is within its capability and is reasonably requested by the Concessionaire but such assistance shall be without prejudice to the obligations of the Concessionaire.
