The prosecution has the burden of proving the defendant's guilt beyond a Reasonable Doubt. This level of belief is abstract and has been described in a number of way. The best definition is that any doubt regarding the defendant's guilt should not be fanciful or conjured up to avoid delivering a verdict of guilty. This standard is reserved for criminal trials; it is a higher standard than "a preponderance of the evidence"and"clear and convincing evidence,"the burdens of proof used in civil trials.
