The election for trustee takes place at a meeting of creditor, and only unsecured creditor with undisputed claims are eligible to vote. A trustee is elected if creditors holding a minimum of 20 percent of the dollar amount of claims request an election and one candidate obtains the votes of creditors holding a majority in the dollar amount of claims actually voting. If a trustee is not elected, the interim trustee serves as trustee. The unsecured creditors eligible to vote may also elect a creditors' committee of 3 to 11 member to consult with the trustee and to submit questions regarding the debtor's estate to the court.
