Law and society are closely interconnected. Though legal norms occasionally purport to change social life, more often than not they coincide with the pertinent social conventions. The officials who design the law both consciously seek to adjust it to the characteristics and needs of society, and are affected themselves, as members of society, by those same characteristics and needs. This assumption may also be applicable where legal transplantation is employed; sometimes its function is merely to provide moral support for the preexisting conceptions and policy preferences of society, or to help translate them from the abstract to the concrete.289 Consideration of the sociological dimensions of defamation law, both in general and in the Israeli case, indicates that the aforementioned applies to this Article’s present discussion.290
A. Defamation Law and Society: the Paradigmatic German-American Contrast
Defamation law is probably one of the legal fields that are most profoundly influenced by the features and ideologies of the respective societies. The paradigmatic dichotomy between Germany and the United States illustrates this proposition well. We have already witnessed that these countries differ dramatically in their defamation laws; as this section will explain, this contrast stems from their dramatically different social backgrounds.
The emphasis that the German thinking places on human dignity, to the detriment of free speech, is commonly linked to the communitarianism and the internal solidarity that traditionally characterize the largely homogeneous European societies.291 The basic vision of such societies is that humans are predominantly social beings. Under their perceptions, the individual’s identity is constituted through the social connections by which she is embedded in and attached to the community, and her very personhood is derived from membership in the community.292 Since such membership

The contention that the strong protection provided to reputation in Germany stems from a broader philosophy of communitarianism and solidarity finds support in the German constitutional rhetoric. German law’s sanctification of human dignity on the one hand and limited protection of speech on the other are rooted not only in the historic features and conceptions of German society discussed so far. They also stem from the much more recent experience of the Third Reich. The founders of modern Germany wanted the new regime to reflect the antithesis of the Nazi ideology, which by its very nature contradicted any notion of dignity and humanity.301 Furthermore, they internalized the lesson of the Weimar Republic that unrestrained political freedoms (including, but of course not limited to, the freedom to distribute false information on public officials)302 could be abused to undermine the political order, and adopted the notion of a “militant democracy” to prevent such an outcome.303
Similarly to the German case, the approach of the American legal system to defamation law is also attributable to its surrounding social setting. American society is characterized, perhaps more than anything else, by individualism.304 Individualism regards each person as a freestanding entity whose essence and nature precede any relation with others.305 Preserving a
