In this issue we cast the net wide, dealing with public,
private and criminal law. Some troublesome points about
the relationship between private nuisance and planning
permission were tantalisingly close to determination in
Davis v Tinsley – the Deeping St Nicholas windfarm
case – before it settled part-way through trial. We
examine the issues that now await decision another day.
In public law we report on the defeat for former Energy
Secretary Chris Huhne’s attempt at retrospective
reduction of Feed-in Tariffs (FiTs), and sound a note of
caution about the importance the courts now attach to
meeting the public’s expectations of the consultation
process. And in environmental crime we look at recent
warnings from the Court of Appeal for those involved in
transfrontier waste shipment.
