Considerations such as these leave as the only option producer account¬ability, which is the strict liability standard in place within the United States at present. But critics charge that this system is unfair, costly, and socially unwise. It is unfair because it holds producers responsible for things over which they had no control (since there was no negligence involved, there was nothing they could have done otherwise). It is costly because it adds significant hidden costs to every consumer product and places domestic producers at a competitive dis¬advantage with foreign businesses. It is socially unwise because it discourages product innovation and encourages frivolous and expensive lawsuits.
