We currently employ around 50 people in Thailand, of whom 3 are foreigners. In our Head Office, we have an HR person who deals with the work permits and visas of the foreign staff.
Due to a clerical error, the work permit of one of our foreign staff was allowed to expire in July, and the error was only picked up in August around 1 month after the expiry date.
At that time, our HR person went to the Labour department, and sought their advice. The Labour department cancelled the old WP and provided a new one stating that this would be acceptable to the Immigration department.
At the end of September the HR person began the renewal process for the same staff members visa (visa and re-entry permit, expires 21st Oct), at which time the immigration officer would not renew the visa, stating that the work permit had changed. They advised at that time leaving the country on the 21st Oct and returning on the 22nd Oct on a tourist visa to begin the process again.
Worried that this would cause further issues, I requested that the HR person return to Immigration to ask if we could cancel this visa and work permit, and start the correct process again immediately, however the advice which we are now being given by the Immigration Department is that the staff member should leave the county immediately and not return until after 21st October. They also mentioned the potential for that staff member to be banned from re-entering Thailand for a year.
This does not seem correct, and I assume that there is another process that would allow us to do this the right way. We have made a basic data entry error, which has resulted in this problem and are happy to accept responsibility, pay fines and ensure that our company and staff are not placed at risk.
