C. Final Acceptance Certificate (FAC) that issued by the Contractor
If the absent of CUSTOMER PAC is reached 6 months since HUAWEI PAC issuance. Then Contractor shall issue HUAWEI FAC for closing the rest payment twenty Percent (20%).
If the Subcontractor does not claim any payment before FAC, then subcontractor can claim Hundred percent (100%) of total amount in PO after FAC.
Notes: Each invoice of the Subcontractor shall be STATED in Thai Baht. Any disputed on the Invoice by the Contractor will not be paid until the Parties have agreed on the discrepancies.
Each Invoice shall be in a format to be agreed between the Contractor and the Subcontractor and shall contain due reference to the respective Purchase Order and Sites and shall be backed up with supporting information and as further defined by the Contractor from time to time. The supporting information shall be a copy of the signed Purchase Order issued by the Contractor, a copy of the signed Variation Order, if applicable and a copy of a signed Acceptance Certificate. The invoice shall be in the currency specified in Appendix 3; Subcontract Price. A copy of the original invoice shall be submitted to the Contract Manager of the Contractor.
2 The Subcontractor shall reimburse all the penalty imposed upon the Contractor due to the Subcontractor's failure to comply with the withholding tax requirements as per local tax law.
3 Each Invoice shall be in the format agreed between the Parties and shall have due reference to the respective Purchase Order and Sites. All the invoices provided by the Subcontractor shall be delivered to the Contractor to the following person and address:

4 Unless otherwise agreed by both Parties, all the payments from one party to the other shall be made to the accounts designated to be informed in writing later.
