A successful challenge was made to the two year qualifying period for protection against unfair dismissal on the basis that it amounted to indirect discrimination against women and was, therefore, contrary to Directive 76/207 (R v Secretary of State for Employment ex p Seymour-Smith and Another (1995)). However, in relation to the qualification periods for redundancy payments and possible discrimination against part time employees (who are predominantly female), the appeal was unsuccessful, as it was found to be justifiable (R v Secretary of State for Employment ex p Seymour-Smith and Perez (No 2) (2000)).
