Appointment of Customer Administrator
The Customer appoints CPF (Thailand) Public Company Limited 313 C.P.Tower Silom Road. Silom Bangrak Bangkok 10500 (the "Customer Administrator") to act as its agent to issue and receive all declarations and perform all actions in connection with the set-up and administration of each Service requiring a Customer Administrator as indicated above or considered by the Customer Administrator to be necessary or useful in connection with the appointment, including without limitation, setting up (including signing the relevant initial Set-up Forms and any subsequent amendment thereof on the Customer's behalf), amending, terminating or suspending the relevant Service, amending the set-up of the relevant Service and/or receiving and sending notices for the relevant Service.
The Customer Administrator is further appointed as Agent to issue and receive all declarations and perform all actions in connection with the Pricing Schedule, including any subsequent amendments thereof.
The Customer hereby releases the Customer Administrator from any and all potential restrictions in connection with self-dealing or self-contracting in any applicable jurisdiction, which would otherwise disallow the acting on behalf of the Customer or render the acting of the Customer Administrator on behalf of the Customer ineffective or invalid. Revocation of this appointment by the Customer is only valid three Business Days after receipt of written notice by the Bank at the address set forth below.
For purposes of Customer Self-Administration, the Customer Administrator is empowered to appoint Customer Self-Administrators to
administer the access to Accounts and the use of the db-direct internet Service,
give instructions in relation to such Accounts via the db-direct internet Service in accordance with the service documentation,
give instructions related to master account numbers in relation to trade services, and
appoint individuals as Users and/or Authorised Persons in the db-direct internet Service.
By signing below, the Customer:
agrees that in regards to Asia
o the provisions of the General Conditions and Country Schedules shall also apply to the entire business relationship (excluding any business relationship with the Bank's private wealth, private client or asset management businesses) between a Customer and the Bank unless the General Conditions and Country Schedules have been expressly excluded; all references in the General Conditions and Country Schedules to "this Agreement" and "Service"/"Services" shall accordingly be deemed to include any relevant specific agreement and service or product thereunder respectively pursuant to the aforesaid business relationship; and
o in the event of a conflict between a provision of the General Conditions or Country Schedules and a provision of any specific agreement between the Customer and the Bank, the provision of the specific agreement shall prevail.
