Oral agreements are normally enforceable in Chile. However, the enforcement of such agreements may be more complicated than the enforcement of written agreements. In fact, the plaintiff will first need to prove that the commercial relationship he or she has or had with the defendant was a distribution agreement or a commercial agency agreement, and not simply one or more isolated sales. In addition, he or she will need to prove the agreement is still in force. Thereafter, he or she will be able to enter into the main claim referring to one specific breach of the contract, once he or she has been able to prove that the contract is still valid or in force.
