Regulations on the pilot implementation of the self-certification of origin in ASEAN Trade in Goods Agreement
On August 20, 2015, the Ministry of Industry and Trade (MOIT) issued Circular 28/2015/TT-BCT provides for the pilot implementation of self-certification of origin in ASEAN Trade in Goods Agreements.
Self-certification of origin of goods is the activity that the traders themselves declare the origin of exported goods on the commercial invoice instead of C/O form D. Therefore, a trader who meets the following criteria:
Being a manufacturer and simultaneously an exporter who exports goods manufactured by that trader;
Does not violate rules of origin in the last 2 years up to the time of filing of registration dossier;
Export value to ASEAN granted C/O form D of the preceding year reaches at least 10 million US dollars;
Have staff who were trained, granted certificate of origin issued by the training unit assigned by MOIT;
if demand to participate in the pilot program of self-certification of origin, must submit a registration dossier as prescribed to Import and Export Department – MOIT. Written approval will be issued if there are adequate records and test results showing that production facilities of the trader match the regulations.
A written approval is valid within 1 year from the grant date. Each written approval has a unique code, traders record this number on commercial invoices containing origin declaration, which are issued during the period of validity of the written approval.
This Circular takes effect from October 05, 2015.
