Dear fellow residents of Avalon 1,
With 35 other residents you received an email from Natchaka Chutamanee (Tae), regarding the set up of a legal entity. She says that Kuhn Pongsak would like to help all of us to arrange this.
The RC sought legal advice and now is strongly advising all of you not to support this initiative.
For that we have the following arguments:
There is no proof whatsoever that Kuhn Pongsak is legally authorized to act on behalf of Avalon development for our village;
If that would be the case, then that is another example of Dinkie running away from his responsibilities towards all of us, by letting somebody else cleaning up his mess;
In the time Kuhn Tae was working for Avalon/Dinkie, under his responsibility she had to arrange all issues like legal documents. We all know now that this was not done to our satisfaction;
Avalon Development, Dinkie, Kuhn Pongsak and Kuhn Tae seem to forget that in this village there are not 36, but 107 houses, owned by customers of Avalon who all are harmed by this developer. Not less than 89 residents of this village decided to go together to Court against this developer and his organizations;
The RC is of the opinion that this is one village and that we stand for all residents and not only for owners who happen to live in the only part of the village with perhaps a more or less legal project permit;
Not following the rules by building 108 houses in stead of 36 makes the whole project illegal;
Most important is also that there are ongoing proceedings, resulting in the Governor of Prachuab Khiri Khan ordering the Director of the Land Office Hua Hin Branche to investigate the situation regarding our village and all relevant documents;
Our Bangkok lawyer and the RC visited the Director on Wednesday July 27 and the Director said to support us any way possible;
In the situation that there are ongoing proceedings it is very unwise to interfere with other initiatives.
Today the participants in the lawsuit will receive a separate email to update them about the situation at this moment and to give them full insight in the specification and claims.
