In order to combat the unauthorized use of software as intended by the drafters of the Copyright Law, the Supreme People’s Court addressed the issue in its 2002 Judicial Interpretation. The Court determined in its interpretation that in the event that software is accessed without a license or permission to do so, there is an illegal reproduction of the program’s codes onto a computer storage medium such as a computer’s hard drive or RAM. This infringement on the copyright holder’s exclusive right to reproduction leads to the use of the software’s function as an infringing use of the software
