The Criminal Code (Child Pornography and Abuse) Amendment Bill 2004 (Qld) (the Bill) inserts new offences, with attendant penalty provisions, into the Criminal Code to complement existing child pornography offences. The new provisions contain specific offences concerning the involvement of children in, and making, distributing and possessing material that falls within the definition of, ‘child exploitation material’. Stiff new penalties are provided including a maximum of 10 years imprisonment for involving a child in the making of child exploitation material and a maximum of five years imprisonment for knowingly possessing such materials.
