performed and the general and local conditions in Thailand, particularly, but without limitation, with respect to the following: shipping and land transportation, access to SITE, disposal, handling and storage of materials, availability and quality of labour, water, electric power; climatic and physical conditions, topography and ground surface and sub-ground conditions; equipment and facilities needed for the performance of the CONTRACT, local regulations and customs requirements of the Government of Thailand, and all other circumstances which might in any way effect performance of the WORK or the cost related herewith. Failure of CONTRACTOR to comply with any applicable condition shall be the sole responsibility of CONTRACTOR and be strictly at his cost.
6.2.3. CONTRACTOR shall be responsible for checking and verifying all information used in the WORK, including but not limited to the information provided by OWNER in the PROJECT SPECIFICATION or otherwise or by CONSULTANT. In particular, CONTRACTOR shall verify the correctness and completeness of all information provided in the PROJECT SPECIFICATION. CONTRACTOR shall advise OWNER of any error, omission or inconsistency which he may discover in the information covering the hydraulic, thermal and mechanical design of the PLANT, and OWNER shall advise any amendment which may be appropriate to correct such error, omission or inconsistency. No adjustment to the CONTRACT PRICE or the schedule shall be permitted on account of any such amendment
6.2.4. CONTRACTOR accepts that the specifications and drawings may not be complete in every detail but they are sufficient to complete detailed design. CONTRACTOR shall comply with their manifest intent and general purpose, taken as a whole, and shall not avail itself on any errors or omissions therein to the detriment of the SCOPE OF WORK. Should any conflict, error, omission or discrepancy appear in the drawings, specifications, instructions or in work done by others, CONTRACTOR shall notify OWNER and CONSULTANT immediately, and OWNER will issue written instructions regarding the resolution of the conflict. In such case, all necessary corrections shall be at CONTRACTOR’s expense.
6.3 CONTRACTOR’s CONSTRUCTIONAL PLANT
6.3.1 It is expressly understood that breakdowns of CONTRACTOR’s CONSTRUCTIONAL PLANT during the WORK shall not be regarded as physical conditions which would not have reasonably been foreseen by CONTRACTOR and, therefore, the cost of such breakdowns and any resultant delays and costs thereof shall be to CONTRACTOR’s account.
6.3.2 All CONSTRUCTIONAL PLANT obtained or furnished by CONTRACTOR, which is to be used by CONTRACTOR, shall be in first-class operating condition, safe, fit for the uses for which intended, and suitable for the safe and efficient performance of the WORK. Such CONSTRUCTIONAL PLANT shall be subject to inspection and APPROVAL from time to time by OWNER. Any such CONSTRUCTIONAL PLANT of CONTRACTOR which is rejected by OWNER, as not conforming to the foregoing shall be promptly removed by CONTRACTOR and replaced with CONSTRUCTIONAL PLANT acceptable to
