4.4 Maintenance of the Employer's Facility
(a) The Contractor shall responsible to conduct maintenance work to keep the Employer's Facility in good conditions at all time, throughout the Term. The Contractor shall propose a maintenance plan and procedure for approval according to the Agreed Procedure of the Article xxx. If maintenance work is performed by Subcontractor, the Contractor shall submit signed contract according to the Article 7 [Subcontracting] and provide the subcontractor's maintenance procedures for approval prior to commence maintenance works. Any change of approved maintenance procedure or technique or Subcontractor actions under this provision shall be submitted for re-approval for each change.
(b) The Employer shall not be liable for any damage incurred from approved maintenance procedures and the Contractor shall be responsible to conduct maintenance work to keep the machines in good condition at all times.
