Refer to the claim file attached , the insured 2.5 m. height of boundary wall was collapsed by flood. We have proposed settlement to the insured by deleted the cost of wall beneath the soil as the IAR’s exclusion below (please see the photo of loss and wall plan).
IAR Exclusion ; -
land (including top-soil back-fill drainage or culverts) driveways pavements roads runways railway lines dams reservoirs canals rigs wells pipelines tunnels bridges docks piers jetties excavations wharves mining property underground off-shore property
The insured disagreed. They comment that the insured premise has a difference layer of soil surface between the Insured location and nearby location. The base of boundary wall is located on the same layer of nearby location. So the insured thought their boundary wall is not underground property. In my opinion , if we look from the outside of the insured premise, I agree with the insured that the boundary wall is not underground property. However if we look from inside the insured premise , we consider some of boundary wall is underground property.
