The crime control model looks to the legislature, as opposed
to the courts, as its "validating authority" " and accepts the extensive
reliance that legislatures place on the criminal sanction. The
criminal sanction is assumed to be "a'positive guarantor of social

"victimless crimes" based on consensual transactions.4 This skepticism
is based on the liberal values of "the primacy of the individual
and the complementary concept of limitation on official

abuses could be prevented if the legislature did not insist on
